Question 1
A documentary maker found this video https://www.youtube.com/watch?v＝ddnxgI0- aT4 that the European Commission produced in 1976. She would like to produce an updated version. She has come to you as an expert in EU constitutional law to request a memo that details any inaccuracies in the existing version. She would also like you to propose what else to include on the same themes in the updated version covering significant developments that have happened in the nearly five decades since.
Question 2
Lemongina are the French manufacturer of a carbonated drink made from water, lemon juice, and corn syrup. They seek your legal advice in respect of the following issues that they have recently encountered in their attempts to expand into other markets:
(a) Germany imposes a special import charge on carbonated drinks to ensure that natural, healthier drinks made by traditional German fruit growers remain competitive;
(b) Italy bans all drinks sweetened with corn syrup or sugar to combat child obesity;
(c) For the same reason, Spain bans TV adverts for all high-calorie drinks, including those sweetened with corn syrup. Lemongina worries that 75% of Spanish consumers already buy established domestic brands of high-calorie drinks and that it cannot break into the Spanish market unless it can reach the critical youth audience through TV advertising.
Advise Lemongina around any EU law issues that arise from (a) the German charge; (b) the Italian product requirement; and (c) the Spanish advertising rule.

For reference, Article 30 TFEU provides ‘Customs duties on imports and exports and charges having equivalent effect shall be prohibited between Member States. This prohibition shall also apply to customs duties of a fiscal nature’ and Article 34 TFEU provides that ‘Quantitative restrictions on imports and all measures having equivalent effect shall be prohibited between Member States.’
