You will select a legal case from WestLaw, Nexis Uni, or other informative sources (journals, not magazines, for example) involving a medical–legal issue to review for possible litigation. The topic is to be presented to the class.
The following areas will be presented:
Definition of the legal issue.
Areas of possible malpractice.
Specific areas that the nurse and/or health provider would be able to provide expertise.
Description of the process of triage and/or review.
Recommendations for expert witness participation.
Make sure that you create the following headings:
Introduction to Case – Identify the potential plaintiff(s) and potential defendant(s), setting of the incident, date of occurrence, statute of limitations expiration date, and records reviewed.
Brief Summary – Describe the incident briefly, including the date of the incident and the outcome (illness, injury or death). In the event of a death, identify if an autopsy was performed and a report was reviewed.
Allegations – State specific allegations and identify the individual responsible.
Recommendations – List your recommendations for either proceeding with the case or denying to pursue. Note whether additional materials are needed for review and the sources. Note if experts will need to be retained and the specialties. If experts are to be used, state which aspect of the case the expert would be expected to review.
Each presentation will be given 20 minutes for the case study. All handouts and PowerPoint presentations are to be submitted to the course faculty via the Assignments tab. The presentations will be done by either written APA format paper or you may submit a video for review.
