A patient requests her record in order to review the documentation from her visit to the Emergency Room (ER). You are the Medicolegal Technician at Sinclair Memorial Hospital. You are there to receive any requests and route them to the appropriate individual. First, answer these two questions:
1. Does this patient have the right to their Protected Health Information (PHI)? Explain why or why not.
2. According to federal law, you must respond to the patient’s request for their record within a specified time frame (this answer is not in your book). What is that time frame? Explain where/how you found this information. The source must have been published since March 2018.
A few days later, you then receive a request from this same patient who is demanding that the attending ER physician change the patient’s progress note to reflect, “the patient stated that the patient WAS WEARING A SEATBELT at the time of her MVA” instead of the current physician progress note which reflects, “the patient stated that the patient WAS NOT WEARING A SEATBELT at the time of her MVA”. Now answer these questions:
