It is important for managers and organizations to correctly classify their employees in order to comply with labor laws. The following questions may require some research.
A. What are the three IRS factors that help to determine whether a worker is an employee or an independent contractor?
B. Now, consider NCAA student athletes. Focus separately on the athletes with athletic scholarships and those without athletic scholarships. Based on the factors used to determine whether an individual is an employee, should student athletes be considered employees of the university or of the NCAA, and why? Why are work-study students considered employees but not students athletes? C. Some argue that NCAA student athletes are often compensated in the form of tuition, room and board, and books instead of currency. Historically, that argument that is and has been used to justify and perpetuate the other forms of unpaid labor in this country. What is the difference between salary and compensation? Are they the same? If not, how do they differ? Is it lawful to pay an employee in benefits only?
D. What could be the impact of classifying NCAA athletes as employees? How would universities, coaches, the NCAA, the athletes, and other college sports stakeholders be affected by such a change? Who might benefit and who might be negatively impacted?
