In his 2014 book titled Fire and Emergency Services Administration, L. Charles Smeby suggested that disability cases in fire and emergency services have demonstrated that it would create undue hardships if accommodations were made in public safety jobs. The author also states that, many times, as a result of the law being intimidating to many lawyers, some fire and emergency service (FES) organizations have accepted individuals who are not capable of performing as firefighters or emergency medical technicians (EMT). Many fire and emergency service organizations have job performance requirements that have been validated through testing new hires and veteran firefighters or EMTs in job-related performance tasks. Discuss whether or not your current organization or any organization you have worked for in the past has had a job performance requirement along with the medical, physical, and mental abilities needed to perform the job. If so, briefly describe the requirements for essential job functions. If not (or if none of your previous work experiences apply), discuss your thoughts on establishing job performance requirements that are fair to those with disabilities and do not create undue hardships for those with or without disabilities.
