House of Lords – Co-operative Insurance Society Limited v. Argyll Stores
Question:
Consider the following situation:
A. Caio owns a large piece of land.
B. Caio promises to sell Ticio a significant portion of this land for the amount of 2 million dollars, plus 5 tickets to a popular annual party.
C. Mévio, upon learning of the promise (transaction has not been fulfilled yet), contacts Caio, offering a higher amount, of 3 million dollars, and lifetime tickets to the same popular annual party.
D. Caio then decides to sell the land to Mévio, regardless of the previous promise.
If this episode had taken place in the United States or England, how would the courts position themselves in this situation? In the event that the Court determines that Caio must fulfill his promise and he continues to refuse to do so, could Caio be arrested?
