In State A a woman is permitted to have a late term abortion, that is, an abortion where the fetus is viable and can survive outside the woman’s body. In State A it is also true that if someone shoots at a pregnant woman intending to kill her and kills her viable fetus, he can be charged with and convicted of murder of the fetus. Do you see any ethical and/or legal problems or inconsistency?
Please note this is NOT a question asking about the ethics of abortion. It is a question about the law.
