Please prepare the discussion section of a memorandum to include all the rules provided in the attached rule outline. kindly use SIMPLE and straightforward language. Avoid passive, flowery, and complex language.
As provided in the rule outline, please ensure that each factor includes 1-4 cases. Please limit the discussion section to include the cases only referred to in the outline, DO NOT include any other cases.
In addition, please include the case citation after EVERY AND EACH sentence. Every sentence in the “rule” and “explanation” shall include a case citation, and all sentences that refer to the precedent case in any way in the “analysis” section shall include a case citation.
Also, attached in the final memo instructions, and the statement of facts. In the event that a fact is included in the discussion section based on the final memo instructions that is not included in the statement of fact, please flag such fact. Feel free to include facts that are not in the facts section, however such facts must be flagged.
In brief, the document shall include the following subheadings in each of the four discussion factors:
A. Conclusion: In this conclusion, you should include the general conclusion on the factor. our conclusions should be specific to how the court will likely rule on each specific factors.
B. Rules: In this section, you just want to tell the reader what the rules are.
C. Explanation of Cases: Explanation paragraphs should start with the court’s holding for this factor and shall include the reasoning used in the case.
D. Analysis/application: this section shall include a comparison between the precedent case and the final memo case. The important part of the analysis section is the facts of our case. this section shall be the lengthiest section.
E. Conclusion: this section is similar to part A, however should include a more detailed conclusion.
