A. Prepare civil litigation pleadings:
1. Prepare a Summons and Complaint (a lawsuit – see attachment for a sample first page of a lawsuit) with facts: Sarah Smith is operating a 2008 Volvo north on Interstate 95 in your state. She slows to avoid debris in the roadway and is rear-ended by Joe Handy who is traveling at 80 miles per hour. Her car is totaled; she suffered from facial cuts and a broken right arm, and lost time from her employment as a waitress. (Hint: For complaint and answer, consider causes of action/defenses including gross negligence, negligence per se, comparative negligence, contributory negligence, etc.)
2. Prepare an answer for Defendant Handy.
3. Prepare Interrogatories and a Request for Production to be answered by Plaintiff Smith (Hint: Consider what kind of docs you would need if you were Sarah’s counsel – photographs, police report, medical bills/reports, paystub, etc.)
4. Prepare a Notice of Deposition of the Plaintiff (Hint: Consider what kind of docs you would need if you were Joe’s counsel – photographs, police report, car maintenance records, any existing expert accident reconstruction if countering speed allegations, etc.)

1. Locate and brief a recent U.S. Supreme Court decision that discusses one of the Constitutional protections afforded to a criminal defendant. Include the reference in APA format in your response.
2. Explain the purpose of each of the 5 pleadings listed below. Which would be defense motions? Prepare just 1 of the 5 pleadings listed below (the selection is up to you.) For facts, you can use the facts of the case you briefed at B.1. above, another famous case, or even use made up facts:
a. Motion to Quash Indictment.
b. Motion in Limine (to limit examination of criminal record)
c. Motion to Dismiss;
d. Motion for Judgment as a Matter of Law; or
e. Requests for Instructions as to the definition of “beyond a reasonable doubt.”
