THE ASSIGNMENT:
Read Marsh v Alabama 326 U.S. 501 (1946). As noted in the syllabus you should not be reading case notes or summaries in lieu of the case itself. You will need to develop your ability to read and analyze cases without aid of outside summaries and notes or you will not do well in the course – my exams are not covered by Findlaw, folks. The case analysis assignments should be treated as practice for the exams.
Answer the questions below in a detailed yet concise essay. You should use 14 point font, and your paper should be double spaced with minimum 0.75 inch margins top and both sides. One to two pages using these settings is very unlikely enough to fully address this assignment. Five to six pages should be enough space to fully address the assignment. If you find yourself going beyond six pages you should step away, read the assignment again and be sure that you are specifically addressing the assigned items clearly and directly and not being repetitively redundant by repeating yourself [Was my point made any stronger by stating it three times? Not really.]. If you can make your point in ten words, do not use 15.
This is not an editorial or a persuasive essay. I am not interested in if you agree with the majority, the dissent or neither. I want to see that you have spent the time to UNDERSTAND each of them and the basis for the conclusions reached by the majority opinion (which is the statement of what the law is, AKA precedent) and the dissenting opinion (which is not precedent, not a statement of what the law is but can still be very useful in future / other cases with slightly different facts or in making analogies to a similar but not identical situation).
Completely but concisely address the following:
1. What are the facts of this case? You should assume that your reader has never read this case and you need to tell the story. This is an excellent place to quote from the opinion, though you should still endeavor to demonstrate that YOU understood the facts (who, what, where, when, why, how)
2. What is the primary legal issue addressed by the United States Supreme Court in this case? [Hint: Justice Black spells this out in very plain language in a single sentence, but you need to demonstrate that YOU understand what Mr. Justice Black’s statement means in lay terms not just quoting him and assuming that does it for this question]
3. What are the KEY facts – that is, those facts that, if changed, might have led the majority to a different conclusion? [Hint: This case has a majority opinion and a dissenting opinion, so be sure to pay attention to both. Even though a dissent is not law (precedent), it can often be used as a persuasive argument in a situation with slightly changed facts.]
4. What differences are there between the Alabama courts’ focus and the US Supreme Court majority focus in terms of legal priciples, balancing of competing considerations and similar.
