Memo Introduction – Your introduction has abundant facts. I would like to see more about your summarized assessment as to strengths and weaknesses.
Facts and Laws: Unlawful Termination – In this section, we want an analysis of all applicable and relevant facts related to this particular issue. You have offered conclusions and also somewhat the facts to be determined. Try and outline the relevant facts that will be applied to the law found.
Facts and Laws: Contract Issues – See above.
Laws: Laws – You make reference to several “laws” that seem to apply to the issues in play. However, aside from the PDA, none are identified in the brief. In legal writing, you need to identify, explain and cite the law necessary to your argument. To be vague is not persuasive.
Unlawful Termination – You have raised one relevant case. It was thoroughly briefed, although you might try focusing the briefing on key facts, issues in dispute, and the holding in the case. I would also like to see more than one case in support of your premise.
Precedent: Contract Disputes – This is a sound case. However, it needs to be better briefed. Identify the relevant facts, and thye isue in dispute, and explain how the court’s holding is applicable to this case. Show the reader, this is what happened in that case, and that is relevant because…. . Try and find more than one case as well.
Facts to be Determined: Facts – In this section and the next, you address some facts that must be established in order to prevail. You have also elicited some good reasoning.
Facts to be Determined: Establish – See above. Give more analysis as to why these facts are key.
Application of the Law to the Facts – Your application focuses solely on stautory law. However, you leave out som, every important enacted or doctrinal laws: Title VI and the PDA, and the “at will doctrine” as well. Additionally, you make no mention of any case precedent. The better authority often lies there.
Assessment: Public Perception – You raise some good points. However, in addressing “prior notice” why do you presume Greene’s held off telling Lawson? Where is that in the given facts? If Lawson was treated identically to all other jr. exec, secretaries, do you think the public will believe Lawson deserves special/better treatment because she was pregnant?
Assessment: Damages – You offer some sound and reasonable options with addressing the pub;ic reaction.
Assessment: Business Practices – You raise osme sound options moving forward.
