Read the notes on the “Necessary and Proper Clause,” Article 1, Section 8, Clause 18 on the concept of Federalism. Choose an issue that you believe should be a law, and make a case for its passage and implementation according to the “necessary and proper” clause.
“[The] Congress shall have Power […] To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution [in the Government of the United States, or in any Department or Officer thereof].”
Known as the “elastic clause,” the “necessary and proper” clause is not as expansive as the term “elastic” would suggest. In section 8, clause 18, the Founders enumerated 19 very specific powers delegated to the legislative branch.
This gives the Congress power to legally implement its delegated constitutional powers. In Federalist No. 44, James Madison defines the significance of the clause: “No axiom is more clearly established in law, or reason, than that wherever the end is required, the means are authorized.”
Consider the following:
The Tenth Amendment is one of the most contested points between Federalist and Anti-Federalists during the ratification of the Constitution.
It is a question of means v. ends. Laws must be legitimate (proper) and must be necessary to the purpose of government; “to secure the Blessings of Liberty.” Both the means and the ends must be legitimate—constitutional.
It is referred to as the elastic clause because it is one of the most powerful clauses in the Constitution. It “stretches” Congressional powers. If the clause is applied too broadly, it encourages government growth at the expense of individual rights.
Remember, the goal is to preserve liberty (freedom from restraint of government) and our natural rights.)
The elastic clause gives the Congress more power than those stated in the Constitution.
