The primary case you will analyze in Part I of the midterm exam concerns cheerleaders who want to display banners for football players to run through at the start of the football games. The banners have Bible verses written on them. The school banned the banners on the grounds that the message on the banner was a violation of the Establishment Clause. Upon appeal, a judge ruled in favor of the cheerleaders. The case is being appealed to a higher court and rests there at this time. By reading the 2 articles from the New York Times titled, Cheerleaders with a Religious Message and Texas Cheerleaders, and listening to the CBS news report, you will get a good perspective on the issues of the case.

After carefully reading the documents and listening to the news report from August 2014, compile evidence in a Word document. Provide evidence for the plaintiff (students) and evidence for the defendant (school) which should consist of the constitutional right being debated and three (3) court cases that support each position. Each case listed should include a one sentence descriiption as to why that case is important for the defendant or plaintiff. For example, if this were a case about searching a book bag, I might use New Jersey v. TLO – this case allowed principals to search the book bag if the principal had reliable evidence that creates a reasonable suspicion that some school rule was being violated.
