Course: THE CURRENT PROBLEMS IN THE EUROPEAN HUMAN RIGHTS LAW
As already mentioned, the course would have four constitutive parts:
– firstly, the role of the European Convention of Human Rights in the transformation of the domestic legal systems inside wider European area and within the EU and Council of Europe countries;
– secondly, the relationships between the international law and the law developed and nurtured by the Council of Europe;
– thirdly, the role of the Council of Europe in facilitating compliance with its soft and hard law;
– fourthly, the practical components on application of the Council of Europe soft and hard law, European Convention on Human Rights in the domestic judicial proceedings, legislative practice, academic work, etc.
Grading of the research paper and presentation will be based on the following criteria: 1) relevance of the research question to the course and application of various methods of legal research – 10%; 2) analysis of relevant EU and national case law – 10%; 3) academic structure and quality of presentation – 10%.
