Burbank, California police seized a large quantity of drugs from
three separate residences based upon information received from a confidential
informant and utilized for the search warrant to satisfy the probable cause
need. Defendants made motion to suppress evidence from the search warrant and
the District Court agreed that the state case was insufficient in establishing
probable cause; therefore the exclusionary rule should apply. The Court of
Appeals denied motion for making a good-faith exception to the exclusionary
rule.

The U. S. Supreme Court reversed the decision of The U.S. Court of
Appeals for the Ninth Circuit that denied a motion for issuance of a good faith
exception to the exclusionary rule for the government.

The original intent of the exclusionary rule was to prohibit police
misconduct. Officers did not commit police misconduct with the information
presented to the judge for the affidavit and the judge accepted such
information to be true according to the law at the time so evidence should be
admitted. A mistake occurred by the judge not having the confidential
informant’s information corroborated and establishing the reliability or
creditability of the informant. Therefore, evidence obtained was done so in a
good faith execution of the warrant.
