Workshop One pointed out that the Founding Fathers designed a judicial system that would tip the scales in favor of letting a guilty person go free in order to minimize the chances of sending an innocent person to prison. Yet, even with this system design, we frequently read about people who were found guilty and have spent years in prison only to be exonerated. Of course, as those who study our system would predict, there are cases in which the evidence seems overwhelming yet, the jury returns a not guilty verdict. While our Founding Fathers would prefer the latter, an apparently guilty person going free, both are really an affront to justice.
True justice would seem to demand two elements: (1) only the guilty are convicted, and (2) all those who are guilty are convicted. Knowing that mistakes would be made because fallible human beings would be in the roles of prosecutor, defense attorney, judge, and jurors, the Founding Fathers so valued liberty that they focused on the first element and “rigged” the system to force more errors of letting guilty people go free. While this system is widely believed to be one of the best designed by man, is it truly just?

Policy making in cases of sex offenders has taken a circuitous route from being localized to being addressed at the State and finally at the Federal levels. In the same year that the
Violence Against Women Act was authored (1994) Congress introduced legislation that addressed sex offenses. These began with the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act that required states to register and track the location of sex offenders for ten years after their release. There have subsequently been a number of laws passed by Congress to encourage states to track offenders robustly or risk losing state funding. How this is done is left to the discretion of the states. On a federal level, The Pam Lyncher Sexual Offender Tracking and Identification Act of 1996 required the FBI to establish a database of offenders. Residency restrictions for sex offenders are not universal but they are very restrictive. Because finding a place to live can be so difficult if an offender registers, there is widespread non-compliance. Your text will cover this in Chapter Four as well as self-protective behavior of community members.
