The contracts you will be using are in the Contracts Module.
There are two questions for this Contract 1. I am looking for the ability to read and comprehend the contract so the appropriate contract clause can be applied to the questions connected with each contract. In order to answer the contract fact scenario, you will also need to be able to identify the legal concept that is applicable to the situation described. This is an analysis so please treat it as such. Your personal opinion is not appropriate.
There are correct answers for each question. If a student discusses a different legal theory for answering the questions, partial points will be given. In cases of complete or partial answers, text references are mandatory to support the remedy proposed by the student. A text reference that has no bearing on the remedy or legal arguments will be counted as “no text”. For example, if any contract has an issue of risk of loss, referencing the text on contract formation will not meet the requirement. The sections of the text that you have read contain all the information you need for this analysis.
Please remember to reference the applicable parts of the contract that you are using to answer each question.
A student will be given 4 points for the text reference, 4 points for the contract reference, with 18 points for the analysis itself.
The remaining 4 points will be given as a spelling/grammar score. Following is the prompt.
Residential House Lease
The following question is based on the Residential House Lease found in the Contracts Module. Please reference the Lease by clause number as you answer the questions.
Essay (2 complete paragraphs with text references to support your answers)
Bob, the landlord, refuses to fix a small gap in a windowsill in the basement window that was there prior to the current tenant. Lucia, the current tenant, has just discovered the gap after a heavy rain. The consequence is that black mold has been forming in the basement for quite some time. Lucia still has significant time remaining on her lease. Lucia has notified Bob in writing by email of the mold and leak issue but has received no response. She is concerned about the premises becoming unsafe to live in. It has been 14 days since she emailed him her notification.
What are all of Lucia’s options if Bob declines to do the repairs?
Please discuss all remedies Lucia may seek. Please remember to reference the lease (clause and section) and text (chapter and section) to support your analysis.

Action ItemsIn Brazil, the export industry always finds ways to cut costs. The international community expressed its dismay at the manufacturers’ latest cost-cutting decision to replace flouride with diethylene glycol in toothpaste. Flouride is designed to strengthen teeth enamel. Diethylene glycol is a poisonous substance used to make chemicals that are widely used by the automobile industry. The end product exported from Brazil was poisonous toothpaste that was not labeled to indicate that it contained diethylene glycol. When the poisonous chemical was found in the toothpaste, Costa Rican government officials issued a warning telling consumers to discard the toothpaste. In 2019, a study found that toothpaste containing diethylene glycol was harmless if the chemical concentration was below 15.6 percent. The contaminated toothpaste found in Costa Rica contained levels as high as 5 percent. Costa Rican government officials warned that it was unsafe in any concentration. It is especially harmful for children, as well as those suffering from weakened kidneys.
In July 2020, due to growing concern about the safety of the imported toothpaste, the Costa Rican government banned all manufacturers from using diethylene glycol in toothpaste. Investigators believed that the toothpaste originated from two small manufacturers in the Brazil but the manufacturers denied any wrongdoing.
The contaminated toothpaste was found in five shipping containers but there have not been any confirmed illnesses or deaths from using the contaminated toothpaste.
If you were manufacturing toothpaste and decided to substitute diethylene glycol for glycerin, would you consider it your ethical obligation to tell the consumer?

In both Chapter 7 and 8, the possibility of industry self-regulation is discussed. Why is self-regulation so difficult for companies to achieve with respect to environmental matters? Consider the Indonesia video. Are companies subject to the same pressures with respect to marketing? Compare and contrast the concept of industry self-regulation with the federal statutes you research (FTC and environmental); give special consideration to the theory that underscores the federal statutory scheme. When you are the owner of your own company and directing its strategic plan, what ethical theories will guide you in these two challenging areas? Fully describe your ethical reasoning for your decisions, comparing and contrasting the six theories.
Remember to review and revise your paper to MBA graduate-level writing style.
