Overview
In this discussion, you will be using the below scenario to apply criminal law in your state.
Scenario
It is 2:00 a.m. on Halloween night, and you are on patrol in a marked squad car on Main Street in your city. Suddenly, you see two females dressed in costumes, fighting in the middle of the road. They are both on the ground, swinging and clawing at each other. You stop your squad, turn on your emergency lights, and the fight continues. You walk up to them and yell, “Police, stop!” Both females stop swinging but now cling to one another – refusing to let go. Another officer arrives, and you are able to get both handcuffed. The females are intoxicated and have minor injuries. One has a scratch underneath an eye, and the other has a bloody nose. Both demand that the other should be arrested. You speak with an anonymous witness who said they were fighting over an unidentified male.

720 ILCS 5/12C-60 Curfew
(1) A minor commits a curfew offense when he or she remains in any public place or on the premises of any establishment during curfew hours.
720 ILCS 5/26-1 Disorderly conduct
(1) A person commits disorderly conduct when he or she knowingly does any act in such unreasonable manner as to alarm or disturb another and to provoke a breach of the peace.
This scenario involves two females that are past the curfew hours. One of the Illinois crime statues states curfew as a criminal code meaning they were past the time they legally could be out. The state indicates any minor 17 and younger must be at home by 12:00am and here these females are still out at 2:00am. When you pull up to the scene you see both females fighting in the middle of the road causing disorderly conduct which is also stated as an Illinois crime statue. These females can both be charged with misdemeanor so an officer has the right to arrest them.

609.224 Assault In The Fifth Degree
Subdivision 1 Misdemeanor
1: commits an act with intent to cause fear in another of immediate bodily harm or death; or
2: intentionally inflicts or attempts to inflict bodily harm upon another.
609.72 Disorderly Conduct
Subdivision 1
1: engages in brawling or fighting; or
2: disturbs an assembly or meeting, not unlawful in its character; or
3: engages in offensive, obscene, abusive, boisterous, or noisy conduct or in offensive, obscene, or abusive language tending reasonably to arouse alarm, anger, or resentment in others.
The two statutes that I used explain that if you intentionally inflict bodily harm upon another that’s assault in the fifth degree, which they both were intentionally doing so they could be charged with that misdemeanor. The disorderly conduct statute stated that if a person engages in brawling or fighting that’s disorderly conduct which they both were doing.
