Module 1 Assignment: Beyond the SOP: Digital Evidence Collection in Dynamic Crime Scenes

First watch this video on What is an SOP: What is a standard operating procedure (SOP)?

Then use the SOP for the Madison Police Department as a guide to complete this assignment: City of Madison SOP Digital Evidence collection

Assignment Overview: This case analysis explores the challenges of digital evidence collection in dynamic crime scenes, focusing on the balance between standard operating procedures, officer safety, and evidence preservation.

Scenario:
You are a police officer responding to a domestic violence call where the injured victim claims there is video evidence of the assault on the suspect’s smartwatch, which is synced to the suspect’s phone and cloud storage. While speaking with the victim on scene, the victim also claims there may be “kiddie porn” on the suspects devices. The suspect is still on scene and is becoming increasingly agitated while you sort out the incident. How do you handle this situation?

Please number  your responses when answering the following questions:
1. Upon arrival on scene, how would you balance the immediate safety concerns and visible injuries observed on the victim with proper digital evidence collection procedures since the Suspect is still on scene?

2. Explain what an SOP is and why it is important for agencies to have SOPs.

3. Based on your department SOPs on digital forensic evidence, describe how you would secure and/or collect potential evidence at the scene? Refer to the MPD Standard Operating Procedures. (NOTE: If you are currently employed with a law enforcement agency, then use your own SOP)

4. Explain how your police officer actions in response to this scenario might affect the admissibility of the evidence in court.

Consider these factors in your response:
Chain of custody requirements, Risk of evidence loss, Suspect remaining on scene, Officer and victim safety, need for immediate evidence preservation, and department policy.

Assignment Requirements: Include a title page, a reference page of resources used to answer questions 1-4, and submit a typed MS Word document. Length: 2 pages max excluding title page and reference page. Minimum of two scholarly resources.

Clearly number your responses for grading. Use of proper grammar and sentence structure is expected.

This assignment focuses on balancing officer and victim safety, following SOPs, and preserving digital evidence at dynamic crime scenes. The guide below breaks down how to organize your answers and address each component effectively.

📌 Step 1: Understand the Assignment

  • Watch the video: What is an SOP?

  • Review the Madison Police Department SOP for Digital Evidence Collection.

  • Read the scenario carefully: Domestic violence call, victim injured, suspect on scene, potential digital evidence on smartwatch/phone/cloud.

  • Identify key concerns:

    • Officer and victim safety

    • Evidence preservation (smartwatch, phone, cloud storage)

    • Suspect behavior and legality of collecting digital evidence

    • Chain of custody and admissibility in court

📝 Step 2: Numbered Responses Outline

1. Balancing Safety and Digital Evidence Collection

  • Prioritize immediate safety: secure the scene, attend to victim injuries, call for backup if needed.

  • Separate victim and suspect to reduce risk.

  • Document visible injuries thoroughly.

  • Determine what digital evidence is at risk of being lost and plan to secure it without compromising safety.

  • Example: Do not handle the smartwatch/phone until suspect is controlled, but ensure they are isolated from evidence.

2. SOP Explanation

  • Define SOP: Standard Operating Procedure – a written set of step-by-step instructions for routine operations.

  • Explain importance:

    • Ensures consistency in evidence collection

    • Protects officer and public safety

    • Preserves legal admissibility

    • Reduces liability for mishandling

3. Securing and Collecting Evidence (per MPD SOP)

  • Follow the MPD SOP on digital forensics:

    • Identify and document devices without interacting with them directly

    • Place devices in Faraday bags or isolate from networks to prevent remote wiping

    • Photograph devices and scene

    • Collect devices after suspect is secured, maintaining chain of custody

    • Document time, date, personnel involved

  • For cloud-based evidence:

    • Obtain warrants or legal authorization before accessing

    • Record metadata and account details accurately

4. Effects on Evidence Admissibility

  • Highlight factors affecting court admissibility:

    • Chain of custody lapses

    • Evidence contamination or loss

    • Improper handling per SOP

  • Show how adherence to SOP, proper documentation, and controlled collection strengthen credibility of evidence in court.

🧠 Step 3: Writing Tips

  • Include a title page and reference page.

  • Use APA format for at least 2 scholarly resources.

  • Keep document concise: 2 pages max, excluding title and references.

  • Use clear, numbered headings to align with the assignment questions.
