STEP 2: Address the Prompt
Answer these questions:
Discuss the practice of plea bargaining, including how it works, its pros and cons, etc.
Discuss the privilege against self-incrimination, including who may invoke it, when it may be invoked, what it does and does not apply to, etc.
Discuss the fundamental conflict between the confrontation clause and the admission of hearsay evidence and the current state of the law on this topic since the Crawford v. Washington case.
Discuss the exclusionary rule, including how it operates, its various exceptions, and its social costs.
Discuss administrative or “special needs” searches, including their requirements/limitations. Discuss some common examples.
The midterm essay exam will be five questions worth ten points each, for a total of fifty possible points for each exam. Students should submit approximately one page of writing in response to each question. Each answer should not exceed two pages. You should rely primarily on the assigned course materials when completing the exams. Do not try to just google the questions!
