DISCLAIMER
This guide is intended only as a brief and simplistic introduction to legal research and as such give only a general overview using only a few of the more common and readily available legal reference materials.

INTRODUCTION
Please be aware that most cases involving medical negligence or malpractice never go to court, but are settled out of court. Court cases settled at the local court level are not published, only cases that ae appealed to a higher court are published. Cases may be appealed to State courts and to Federal District courts and all the way to the Supreme Court. The Supreme Court only rules on questions of constitutionality, any other legal ruling is referred back to a lower court.

Another thing that any student doing legal research should know is the difference between the three forms of law.

STATUTORY LAW
Statutory law can be defined as the original laws enacted by a body legally authorized to pass laws, such as the Congresses of the United States or the State of Louisiana. When signed by the President or the Governor, they become law and are eventually incorporated into the United States Code (U.S.C.) or the Louisiana Constitution.

ADMINISTRATIVE LAW
Administrative law, also referred to as quasi-statutory law, refers to the rules and regulations which are written by agencies. These agencies are given the authority by Congress to write and enforce these rules. The Federal Register and the Louisiana Register are the mediums for notifying the public of rules and proposed rules for all Federal and Louisiana State agencies and departments. After publication in the Register as a final rule, the regulations are incorporated into the Code of Federal Regulations (CFR) or Louisiana Administrative Code.

CASE LAW
Case law refers to cases decided in courts of law, at appellate courts on the federal or state level, or, at the highest level, at the U.S. Supreme Court. These cases are adjudicated based on the court’s interpretation of statutory laws and the precedence of previous court decisions. Supreme Court cases are found in United States Reports and cases from Louisiana appellate courts are found in Southern Reporter 3d series (West).

ETHICS
Although not laws, many professional associations have codes of ethics by which their member agree to abide. Failure to abide by the ethics may cause a person to be removed from the association and occasionally to be barred from practicing in that profession.
LEGAL ABBREVIATIONS
Another thing to be aware of is legal abbreviations. Most legal abbreviations are standard in form regardless of the legal resource used. If unsure of the abbreviation, use Bieber’s Dictionary of Legal Abbreviations.

Understanding Case Citations
A case citation identifies the parties in the case, the text in which the case can be found, and the year in which the case was decided. For example, consider the citation Boulia v. Superior Court (Glenchur), 225 Cal. Rptr. 297 (Cal. Ct. App. 1986):

• Boulia v. Superior Court (Glenchur) identifies the basic parties involved in the lawsuit.
• 225 Cal. Rptr. 297 identifies the case as being reported in volume 225 of the California Reporter at page 297.
• Cal. Ct. App. 1986 identifies the case as being decided in the California Court of Appeal in 1986.

In general form of the legal citation is: volume/titlesetpage/section
For example:
42 U.S.C. 263b stands for Title 42 of the United States Code, section 263b: Mammography Quality Standards Act of 1992
187 So.3d 436 stands for Volume 187 of the Southern Reporter, 3rd Edition (Louisiana Cases) page 436: Plaintiffs Richard and Melissa Dupuy (the wife of Richard Dupuy) filed suit against NMC Operating Co., L.L.C., d/b/a The Spine Hospital of Louisiana (“Hospital”). (Patient brought medical malpractice action against hospital for alleged improper sterilization of equipment.)

LEGAL TERMS
Most texts you will look at use very specific language. LSUA library has several different dictionaries, encyclopedias, and thesauri that can help you better understand the language used in law books.

ONLINE LEGAL RESOURCES
There are an almost overwhelming variety of informational resources available via the Internet. I have selected a few specific sites which I think are best suited to the needs of RADT 3300.

www.findlaw.com click cases search under all circuits

www.casetext.com you have to sign up to read cases but it is free.

https://scholar.google.com/ click on Case law then select courts. It is free.

WARNING: Every site is different. State and Federal court internet sites may or may not have case information on those sites. Likewise, not all states have regulatory information available on their government internet sites. Even sites that give court cases may not give the complete case but only the opinions of the court or a summary of the case. Not all court or regulatory sites have search engines that allow for keyword searching of the text of cases or regulations.

Final Project:
For your final project, each student will write a brief (1-2 page) summary for each of three legal cases using below as a resource. Cases may be located through print or internet searches. The cases can be related to any legal issue affecting healthcare administration, education or clinical practice.

For each case, students must also submit copies of the “labeled” original cases. On the case indicate the citation, Case Name, Docket #, Date of Decision, Lawyer, Judges, Topic, Relief Sought, Issue, Facts, Holding, Reason, and Decision of the Court.

I encourage you to work on this project throughout the semester!

If you have questions, please post in the news forum so that everyone is privy to information. Please DO NOT email me privately to ask a question regarding this project.

Case Presentation Format
Students are encouraged to locate a recent case and discuss it in the following format:

1. Citation. Students may wish to research cases cited in this text in order to gain a deeper understanding of the topics covered. A case citation describes the identity of the parties in the case, the text in which the case can be found, and the year in which the case was decided.
2. Topic. What is the main topic of the case.
3. Relief Sought. What is the plantiff asking?
4. Issue. The issues discussed in any given case are selected for review on the basis of medical and legal importance to the healthcare professional. Although any one case may have multiple issues, only those considered pertinent are reviewed here.
5. Facts. A review of the details of the case.
6. Holding. The court’s ruling based on the facts, issues, and applicable laws pertaining to the case.
7. Reason. The rationale behind how the court arrived at its decision based on the facts, issues, and relevant laws surrounding the case.
8. Significance. Discuss the significance of the ruling of the court.
