Assignment: Supreme Court Justice Louis Brandeis referred to federalism as laboratories for democracy. Meaning states could test out different policies on a smaller scale before (if ever) the federal government adopts similar policy at a much larger scale. The federal government takes a step back and semi-allow states to make laws which technically conflict with federal law (remember the Supremacy clause: Federal law will always trump state and local laws). This has happened many times throughout our history.
Curently, numerous states have made their own cannabis or marijuana laws – either for recreational or medical use or both – which conflict with federal law(s).
Pick one state which has already implemented its own policies allowing marijuana. What is that policy and how does it compare to federal law? What are the advantages and disadvanges of that policy? What are the consequences – either intended or unintended, good or bad? And finally, what do you think of said policy?
