Operations Management concepts can be observed almost everywhere in our regular lives. The following assignment is focused on lines and waiting time management concepts. The purpose is to recognize Operations Management concept, its applicability, and how it affected your experience.

 

Out of the themes listed below, please select one and think of your experience as a customer/client/supplier when you waited to be serviced (e.g. line at the restaurant, doctor’s office, email response, internet order). Why did you have to wait? Name three (3) reasons. How did the line (physical in the office or virtual) and wait time were managed? What approach(es) were used? How effective were the approaches to eliminate the wait time and line? Provide three (3) suggestions of how you would have handled the situation differently, using lines and wait time management concepts and terminology.

Part III – Vendor Risk Management – Skills Assignment

Recall from Parts I and II

  • Ethical coffee purchases green coffee from farmers in Colombia, Costa Rica, Yemen, Saudi Arabia, Ethiopia, and Papua New Guinea. After its local agents (all independent contractors) have sourced and purchased the coffee beans, Ethical Coffee contracts to transport the beans to the closest suitable shipping port. Ethical Coffee also contracts with port warehouses to store the coffee until the shipping date. Ethical Coffee enters into contracts with container ship companies to have the beans shipped to New York, San Francisco, or New Orleans. Once the beans arrive in the U.S., they are transported by truck and/or train to the company’s 5 regional roasting plants.
  • After the coffee beans are roasted, they are packaged and shipped to grocery stores and to Ethical Coffee’s 10,000 coffee shops.
  • As the supply chain and vendor risk manager for Ethical Coffee, Inc. you are working with Legal and Treasury/Finance to evaluate and eventually engage a new transportation vendor, Premier Global Transportation.
  • A former government figure in Saudi Arabia formed Premier Global Transportation in 2021 and currently serves as CEO. Due to the CEO’s contacts within the Saudi Arabia government, Premier Global Transportation enjoys great perks, including but not limited to favorable exporting and customs terms.
  • Premier Global Transportation has established strategic hubs in not only Saudi Arabia but also Yemen and Ethiopia.
  • Premier Global Transportation has completed its proposal to transport and temporarily store at port green coffee from farmers in Ethiopia, Saudi Arabia, and Yemen.
  • Premier Global Transportation’s proposal was financially appealing as the numbers were 10% less than Ethical Coffee, Inc.’s current transportation and hubbing (warehousing) cost for Ethiopia, Saudi Arabia, and Yemen.

New Facts

  • After extensive due diligence and heated negotiations, Ethical Coffee executed a master service agreement with Premier Global Transportation and has used its transportation and hubbing services for over six months.
  • Thus far, Premier Global Transportation has performed satisfactorily. Despite a shortage in drivers in the United States, Premier Global Transportation has a robust fleet of drivers. 
  • Ethical Coffee’s Supply Chain Vice President manages the relationship with Premier Global Transportation and during a quarterly business review commented that he was impressed with Premier Global Transportation, noting that the deliveries were all timely and his experience with Premier Global Transportation is exceptional. “It is good to have a constant group of drivers. Domestically, we have experienced a shortage in drivers and are always looking for skilled and motivated drivers.” In response to this comment, the CEO of Premier Global Concentration stated, “We always have drivers due to our phenomenal staffing partners.”
  • Ethical Coffee’s Supply Chain Vice President researched this comment further and learned that Premier Global Transportation had a contract with  a third-party staffing agency that placed new and seasoned drivers for both permanent and temporary work with Premier Global Transportation. The VP further discovered that Premier Global Transportation gave the staffing agency access to its logistics and human resources platforms to permit “seamless” onboarding.

Assignment

After learning that Premier Global Transportation uses a third-party for staffing and gives this vendor access to its systems, Ethical Coffee’s Supply Chain Vice President schedules a follow-up meeting with the Premier Global CEO to discuss Premier Global Transportation and the third-party staffing agency. In preparation for this meeting with the CEO, you must prepare a memorandum outlining:

  1. The risks in having Premier Global Transportation continue providing services to Ethical Coffee, and the controls that are required to address the risks (1-2 pages).
  2. The audit needed to ensure that Premier Global Transportation is complying with the terms of the parties’ agreement (2 pages).
  3. The cybersecurity risk associated with the staffing agency having access to Premier Global Transportation and how that may impact Ethical Coffee (1-2 pages).

Use double spaced, one inch margins, 12 point Times New Roman font.

Civil Litigation Fundamentals –

Nature of assignment: The Module 11 lecture and readings focused on the class action as a key device for mass litigation.

As explained in the lecture and readings, several developments have combined to undermine the class action: (a) Congress passed a law, the Class Action Fairness Act, that pushed most class actions from state to federal court, (b) the Supreme Court, particularly in the Wal-Mart case, made it more difficult to certify a class action in federal court, and (c) the Court has repeatedly enforced arbitration clauses even if they contain explicit or implicit waivers of class actions.

Imagine that you work for a member of Congress who is considering legislative changes to the class action as a litigation device. The member of Congress has asked you to write a brief memo outlining one or more proposals that you would make to reform the class action via congressional legislation. Write a memo of between five and seven double-spaced pages. In your memo, you should do the following things.

First, explain what you see as a key problem or problems with the role of the class action in modern civil litigation. In doing so, make sure you explain how class actions differ from ordinary civil litigation, and create additional challenges.

Second, describe one or more proposals for reform or change to the class action as a litigation device, which could be embodied in a new law passed by Congress.

Third, explain why your proposal or proposals would be an improvement over the status quo.

As with the first assignment (on discovery), you are free to write a memo covering only one proposed reform, or you may write about more than one proposal. However, I highly recommend that you do not spread yourself too thin by trying to write about too many topics. An approach that tries to cover too much ground will likely receive a lower grade because it will be unable to fully explain and defend the changes that are being proposed.

In writing your memo, you are free to consult any outside material you wish, as well as any of the required or optional readings. However, you do not need to do outside research – you can receive a high grade on the assignment based only on the assigned lectures and readings. Please be aware of FSU’s Academic Honor Policy – in particular, make sure that you attribute any material that you rely upon properly and do not plagiarize.

Grading:  Your grade will be based primarily on how well you identify a problem or problems and describe and defend legislative solutions to those problems. I will not grade you based on whether or not I personally agree with your approach. You could reasonably argue, for example, that the class action needs to be strengthened to be reinvigorated as a litigation tool, or in the alternative that it should be further curtailed or even eliminated.

The organization and clarity of your writing will also affect your grade.

Theories

Write a 3–5 page essay analyzing any of the theories (Classical Theory, Neoclassical Theory, Human Resource Theory, Modern Structural Theory, Organizational Economics Theory, Power and Politics Theory, Organizational Culture Theory, and Equity and Expectancy Theory) and the influences that shape organizational culture and their impact in public administration management. Use 3–5 outside sources as research for your essay.

Begin by identifying a public sector organization. You may choose any organization, from a county office to a federal agency, or anything in between.

Describe the organizational culture of this organization.

Remember an organizational culture is the sum total philosophical views, values, behaviors, attitudes, and ideals traditionally demonstrated by the organization. The organization might demonstrate an autocratic or totalitarian approach to leadership. Perhaps they rarely believe in delegation of authority and are known for a failure to implement motivational systems within the organization. Perhaps they are recognized for empowering every level of the organization. The culture will tell you who they are and what their leadership and employee development style is all about.

Then, identify the influences that have shaped the organizational culture. What types of theoretical constructs that you have studied can be seen in your organization? How do the theoretical constructs and other influences impact the organizational culture of this organization? Be sure to discuss both positive and negative effects of these influences.
