Dropbox Special Access: Week 1 – Assignment: Discuss the United States Judicial System and Code of Federal Regulations – DueJan 9, 2022 11:59 PM LHE-7300 v1: Legal Issues in Higher Education (3982983017) Through your readings, resources, and supporting videos you reviewed the structure of the United States judicial system and you are beginning to explore sources of higher education law that are important to a leadership role in higher education. Included were statutory law, case law, and federal regulations. Most federal regulations (Code of Federal Regulations (CFR’s)) relevant to higher education are promulgated under the United States Department of Education. It should be noted that other federal agencies may have limited authority over higher education institutions. For example, the Federal Trade Commission (FTC) can bring an enforcement action against an institution for a deceptive advertisement to recruit students by making false or misleading promises. For this assignment, consider a law or regulatory issue in higher education that is of personal interest to you as a current or prospective higher education administrator. Here are some examples for you to consider: Regulatory issues involving deceptive or misleading student recruitment as noted above (FTC). Regulatory issue(s) surrounding institutional responsibility under the U.S. Department of Education student loan program. Institutional liability for cyberbullying on and off-campus. Higher Education Opportunity Act. International students. Race and national origin discrimination. Prepare a scholarly paper that is organized as follows: Introduction to the topic of interest. Why is it a law or regulatory issue a leadership problem to higher education? The judicial or regulatory body that has jurisdiction. The judicial or regulatory remedies that can be imposed on the higher education institution and/or employee of the organization. Length: 2-3 pages, excluding references References: Include a minimum of 3 applicable statute, case law, or regulations applicable to the topic, including CFRs. The completed assignment should address all of the assignment requirements, exhibit evidence of concept knowledge, and demonstrate thoughtful consideration of the content presented in the course. The writing should integrate scholarly resources, reflect academic expectations and current APA standards, and adhere to Northcentral University’s Academic Integrity Policy.
