General Instructions for all Chapter Problem Assignments:
Follow these General Instructions AND the specific chapter instructions below.
Each Chapter Problem has multiple parts. Follow the instructions for each part.
Go to myLearning, and click on Discussions. Under the Discussion Forum – Chapter 7 Problems – click on the topic, Sample Assignment with Formatting. This will show you how to format your answers. You should also review the Rubric to see how your work will be graded. The Rubric link is at located below.
It is recommended that you type your answers using word processing software.
This way you can use the spelling/grammar check and the word count tools.
You then can copy and paste directly into the myLearning Discussions tool. You must type your answers in the HTML Editor; do NOT attach a file.
Using word processing software also allows you to have a back-up copy of your work if something goes wrong with your internet connection.
For Web-Hybrid and Face-to-Face sections, follow your instructor’s directions for submissions.
When you type your answers, type each question’s number according the sample formatting guide in this module followed by your answer. Do NOT retype the questions/instructions. Do NOT attach a file. Your answers need to be in the message area so that all students have easy access to review.
The Chapter Problems are setup so that you cannot edit or delete a thread or reply. If you mess up with a thread/reply, just start a new thread/reply — except add a note in the Subject (like, Sam’s Answers – Please grade this one). If you need a thread/reply deleted, contact your professor.
You must have 500 words for your answers, and 150 words for your revision.

Part I: Supreme Court Analysis
Read the opinion, Riley v. California, attached as the following PDF document – Riley v. California.pdf. If you want more information about this case, go to SCOTUSblog for Riley v. California. The article, “Get a warrant! Today’s cellphone privacy decision in Plain English” is helpful.
Answer the following questions about the Riley case opinion.
What are the major differences between Riley’s search after arrest and Wurie’s search after arrest?
The Fourth Amendment requires a warrant based on probable cause before police can search a person. One of the exceptions to the Fourth Amendment is a reasonable “search incident to a lawful arrest” (Riley, p. 5). The Court uses the Chimel (p. 6), Robinson (p. 7), and Gant (p. 8) case opinions as precedent. Briefly explain the rule from Chimel.
Briefly explain the rule from Robinson.
Briefly explain the rule from Gant.
The Riley Court talks about a “balancing test” on page 9. How does the Riley Court apply this test to the warrantless search of cell phones?
What is the new rule/test that the Riley Court creates?
What is your opinion of the Riley Court’s analysis?
