For this Mock Trial, you are responsible for working with 1-3 partners to create an opening statement, direct examination of a witness, cross-examination of a witness and closing argument.
Case below
Yvonne Walker and Donaldson were girlfriend and boyfriend for about 4 months. On January 14, 2021, Ms. Walker “broke up with him”. Donaldson was not happy with this breakup and was upset and angry. He would not leave the house until she threatened to call the police. Around 9 a.m., he finally left the house.
Later that day, around 4 p.m., Ms. Walker was driving home. Her 4-year-old son was in the car. Her 13-year-old daughter was at home waiting for her mom’s return. Ms. Walker makes her normal turn down the back alley behind her house and immediately sees Donaldson standing in the alley. She proceeds to park her car and Donaldson “is right at my car already”. He opens the passenger side door and “shoved” the 4-year-old out of the car. The youngster hits the pavement and immediately began to cry. Donaldson then punched Walker in the right side of her head, just above her ear. She then sensed her purse, which was on top of the middle console of her Nissan Rogue, being taken by Donaldson. She tried to hold on to her purse when Donaldson punched her “maybe 3 or 4” more times to the same area of her head. When she could not hold on any longer, Donaldson took her purse and ran away.
The Commonwealth charged Donaldson with Simple Assault (2 counts), Aggravated Assault (2 counts), Robbery and Theft
